General Terms and Conditions of Business
1. Scope of validity
The General Terms and Conditions apply to all services provided by BEA Chauffeurs & Limousines e.K.. The version in force at the time of the conclusion of the contract shall apply.
2. Representation
BEA Chauffeurs & Limousines e.K. is not obliged to provide services in person. BEA Chauffeurs & Limousines e.K. may also use other chauffeurs and companies to provide services, particularly in the event of short-term unavailability and overlapping appointments.
3. Chauffeur service
The service consists of transporting passengers in their own vehicle. Customers can use the service from any point of departure. All BEA Chauffeurs & Limousines e.K. chauffeurs are obliged to comply with the German Road Traffic Regulations (StVO). If a customer behaves in a manner that endangers traffic during an order, BEA Chauffeurs & Limousines e.K. may cancel the order at any time.

4. Insurance and limitation of liability
The Customer is obliged to take out adequate insurance for the motor vehicle provided by him and to insure it against all risks. Even if the vehicle is not fully insured, the Customer shall be liable for any damage caused by gross negligence on the part of the Supplier. In the absence of intent or gross negligence on the part of the Supplier, the Customer shall bear any excess agreed between the insurance company and the Customer, as well as the cost of any increase in insurance premiums. The vehicle must not have any defects which could affect its roadworthiness as defined by the German Road Traffic Licensing Regulations (StVZO). The driver’s assessment that the vehicle meets the requirements of the StVZO does not release the customer from this obligation. The Customer is responsible for the necessary accompanying documents (e.g. registration documents etc.) and is liable for all costs incurred as a result of technical defects in the vehicle and/or insufficient accompanying documents. BEA Chauffeurs & Limousines e.K. shall only be liable up to the amount and within the scope of the third party liability insurance it has taken out. The client or the person to whom the vehicle is handed over in accordance with the order must inspect the vehicle when it is handed over or at the end of the journey. Any damages, defects or other complaints regarding the execution of the order must be reported to the driver immediately. Any claims arising from complaints or notifications of damage which are not made without undue delay shall be excluded in this respect.
5. Cancellation policy
An agreed transport service (for fixed bookings) can only be cancelled by the customer within the following time limits
7-6 days before the service is provided – 25% of the booking of the agreed amount
5-3 days before the service is provided – 50% of the booking of the agreed amount
2 days prior to arrival – 75% of the reservation of the agreed amount
Cancellation fees from 24 hours before the service – 100% of the booking of the agreed amount
Cancellation must be made in writing. The Contractor shall also be entitled to demand reasonable compensation, even if the client is not at fault.
6. Force majeure
Strikes, technical faults, weather-related emergencies and lockouts or force majeure release BEA Chauffeurs & Limousines e.K. from the fulfilment of the contract.

In the winter months, especially in the event of ice and snow, the fulfilment of confirmed orders may be delayed.

The final decision on the fulfilment of an order lies with the vicarious agent of BEA Chauffeurs & Limousines e.K..

7. Invalidity of contractual clauses
Should any provision of this Agreement be or become invalid or void, the validity of the remaining provisions of this Agreement shall not be affected. The parties undertake to replace the invalid or void provisions with new provisions which fulfil the economic content of the invalid or void provisions in a legally permissible manner. The same applies if a gap is found in the contract. In order to fill the gap, the parties undertake to work towards establishing appropriate provisions in this agreement that come as close as possible to what the parties would have intended according to the meaning and purpose of the agreement if they had considered the point.
8. Final clauses
BEA Chauffeurs & Limousines e.K.
German law applies in addition to the General Terms and Conditions. BEA Chauffeurs & Limousines e.K. reserves the right to amend these terms and conditions at any time. Jurisdiction for all disputes
The place of jurisdiction for all disputes arising is the head office of BEA Chauffeurs & Limousines e.K., Hanau.
